Waiver of Liability, Release, and Assumption of Risk

This Waiver and Release is the separate waiver and release form referenced in Section 4 of The Farm Wrestling Terms of Service. Please read it carefully. It affects your legal rights, including the right to sue. **By checking the agreement box and completing registration, you agree to be bound by this Waiver on behalf of yourself and, where the participant is under 18, on behalf of the minor participant.**

 1. Assumption of Risk

I understand that wrestling and the related activities, instruction, drilling, live competition, conditioning, and use of facilities and equipment provided as part of the Camp involve inherent and other risks. These risks include, but are not limited to: sprains, strains, fractures, concussions and other head injuries, dislocations, cuts and bruises, dental and eye injuries, heat-related illness, infectious skin conditions, permanent disability, paralysis, and in rare cases death.

I understand these risks cannot be fully eliminated regardless of the care taken by the Camp, and that they may result from my own actions, the actions of other participants, the condition of the facilities or equipment, or the negligence of the Camp or its staff. **I knowingly and voluntarily accept and assume all such risks, both known and unknown, of participation in the Camp.**

2. Release and Waiver of Liability

In consideration of being permitted to participate, I, on behalf of myself, the participant, and my/our heirs, assigns, and personal representatives, hereby **release, waive, and discharge** The Farm Wrestling Camp LLC and its owners, officers, employees, coaches, instructors, volunteers, agents, and facility providers (collectively, the “Released Parties”) from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, injury, illness, or death sustained in connection with participation in the Camp, **including any such claim caused in whole or in part by the ordinary negligence of the Released Parties**, to the fullest extent permitted by law.

This release does not apply to liability arising from the gross negligence, recklessness, or intentional misconduct of the Released Parties.

 3. Indemnification (Hold Harmless)

I agree to **indemnify, defend, and hold harmless** the Released Parties from any loss, liability, damage, cost, or expense (including reasonable attorneys’ fees) they may incur arising out of the participant’s involvement in the Camp, or arising from any claim brought by or on behalf of the participant, to the fullest extent permitted by law.

 4. Medical Treatment Authorization

I authorize the Camp and its staff to obtain or administer emergency medical treatment for the participant if needed, and I consent to such treatment. I understand the Camp will attempt to contact the emergency contact provided at registration before treatment when reasonably possible. I agree to be responsible for all costs of medical care and transportation. I confirm that the medical, allergy, medication, and emergency contact information provided during registration is accurate, and I will notify the Camp of any change.

5. Representation of Fitness

I represent that the participant is in good health and physically able to take part in the Camp’s activities, and that I am not aware of any medical condition that would make participation unsafe. I will inform the Camp of any condition that arises before or during the Camp.

6. Media Release

I grant the Camp permission to photograph or record the participant during Camp activities and to use those images for promotional or informational purposes without compensation.

7. General Provisions

– **Governing law and venue.** This agreement is governed by the laws of the State of Oklahoma, and any dispute shall be brought in the courts located in Payne County, Oklahoma.
– **Severability.** If any portion of this agreement is held invalid, the remaining provisions stay in full force and effect.
– **Relationship to Terms of Service.** This Waiver supplements and is incorporated into The Farm Wrestling Terms of Service. In the event of a conflict regarding assumption of risk or release of liability, this Waiver controls.

8. Electronic Agreement and Consent

By checking the agreement box and completing registration for the Camp, I acknowledge that:

– I have read this Waiver of Liability, Release, and Assumption of Risk and fully understand its terms;
– I understand I am giving up substantial legal rights, including the right to sue, by agreeing to it;
– I am agreeing to it freely and voluntarily; and
– If the participant is under 18 years of age, I am the parent or legal guardian of the participant, I have the authority to agree on the participant’s behalf, and I agree to all terms above on behalf of both myself and the minor participant.

I understand and agree that completing registration online constitutes my electronic signature and has the same legal effect as a handwritten signature.
